Rippling's AI Services Terms added an AI Actions clause and kept the discretionary fair-use throttle
The AI Services Additional Terms were restamped Last Updated September 8, 2026. New clause 3.4 makes the customer solely responsible for configuring which AI Actions the platform may suggest, draft, queue, initiate or execute. Clause 3.5 still governs consumption by discretionary fair-use throttling, and no fee, credit or token clause appears anywhere in the document.
Two days before this entry’s capture date, Rippling restamped its AI Services Additional Terms. The new material is clause 3.4, “AI Actions”: the customer is “solely responsible for configuring permissions, roles, approvals, and other administrative controls governing whether AI Services can suggest, draft, queue, initiate, or execute, in whole or in part, any action, workflow, configuration, change, data modification, submission, approval request, provisioning, deprovisioning, or other operation” through the platform. Rippling reserves the right to suspend access where an agent “poses a security, compliance, or operational risk”. This is agentic-execution liability written into an HR and payroll platform where an AI Action can mean deprovisioning a user or submitting a payroll change.
What did not change is the consumption model. Clause 3.5, “Fair Usage Restrictions”, still reads: “Customer’s use of AI Services is subject to fair usage restrictions that Rippling may determine in its sole discretion and communicate to you from time-to-time; if Customer exceeds such fair usage restrictions, Rippling may disable or degrade performance of the AI Services.” There is no allowance, no credit pool, no token rate and no overage price anywhere in the document. Rippling also reserves the right to “update or change underlying models at any time” under clause 2.1.
The gap is the story: Rippling shipped AI Spend Console a month earlier to attribute other vendors’ token costs down to the pull request, and its own AI entitlement remains an undisclosed limit enforced by throttling.
The AI Services Additional Terms carry a Last Updated date of September 8, 2026. Clause 3.4 makes the customer solely responsible for configuring which AI Actions the platform may suggest, draft, queue, initiate or execute. Clause 3.5 keeps AI usage under 'fair usage restrictions that Rippling may determine in its sole discretion', enforced by disabling or degrading performance rather than by billing overage.
